SUMMARY OF THE 482 VISA
The Skills in Demand (SID) visa (subclass 482) is a temporary visa that allows Australian employers to sponsor skilled workers to fill positions they can't find suitably skilled Australians for. See Visa Makers for the 482 Visa to PR pathways.
There are 3 stages to the SID visa.
- Set Business Up as Sponsor
- Submit a Business Nomination
- Submit a Visa Application
Core Skills Stream
- Eligibility: Your occupation must be on the Core Skills Occupation List (CSOL).
- Salary: The annual market salary rate should be met and this is required to be above AUD 73,150.
- Duration: Up to 4 years, with Hong Kong passport holders eligible for up to 5 years.
- English Requirement: Must meet relevant English language requirements
Specialist Skills Stream
- Eligibility: Your occupation must be an ANZSCO-listed occupation, excluding Major Groups 3, 7, or 8.
- Salary: The annual market salary rate should be met and this is required to be above AUD 135,000.
- Duration: Up to 4 years, with Hong Kong passport holders eligible for up to 5 years
- English Requirement: Must meet relevant English language requirements
Labour Agreement Stream
- Eligibility: Your employer must have a labour agreement set up with the Australian government.
- Duration: Up to 4 years, depending on the terms of the labour agreement.
- English Requirement: Must meet relevant English language requirements
SID VISA STATUS
A temporary visa You can stay in Australia for the period of time your employer nominates you for up to a maximum period of 4 years or up to 5 years if you are a Hong Kong passport holder. LOCATION
All of Australia is eligible for the Skills in Demand 482 visa. Applicants can be onshore or offshore. You are permitted to live and work anywhere in Australia. |
482 VISA REQUIREMENTS INCLUDE:
EMPLOYEE
- The applicant has worked in the nominated occupation or a related field for at least 1 year and meets the qualification requirements.
- English requirement - there are various ways to meet the english requirements. For example, through sitting an authorised test (eg IELTS, PTE), by holding a certain passport or completing at least 5 years of full-time study in at least a secondary level institution and where most classes were in English. see visa makers for exact requirements.
- The applicant has the skills, qualifications and employment background that Immigration considers necessary to perform the tasks of the nominated occupation
- Skills assessments are required for certain trade occupations and countries. (exemptions apply). All applicants can be requested to obtain a skills assessment though if requested by Immigration.
- There are no age restrictions for the 482 visa.
- The applicant’s intention to perform the nominated occupation is genuine and the position associated with the nominated occupation is genuine.
- If mandatory for the occupation hold the relevant licensing, registration or professional membership. e.g Nurses, teachers, electricians
EMPLOYER
- To be actively and lawfully operating a business in Australia.
- Skilling Australian Fund (SAF) is payable upfront at time of Nomination.
- Nominating an occupation on the ‘Core Skills Occupation List’ (CSOL) for the SID 482 visa.
- Proving there is a ‘genuine need’ for the position to be nominated within the business.
- Nominating the employee to work in the position for a full time position.
- Meeting the Labour Market Testing (LMT) requirements. See Visa Makers as no refunds are provided by Immigration if this requirement is not met correctly.
- Meeting the ‘Annual Market Salary Rate (AMSR)’ criteria and the ‘guaranteed annual earnings’ are above $73,150 per year.
