Breaking News - Immigration add 'English Language Ability' button to Partner Visa Applications
This could mean that the much discussed English Language changes could be coming soon for Partner Visa applicants.
It must be noted that the legislation has not been amended as yet so this has not been implemented as yet.
Functional English
Our opinion is that Immigration will require the level of 'Functional English'. There are a wide variety of ways of meeting the functional English level. For example, having a passport and citizenship from the UK, Ireland, USA, NZ and Canada, scoring an average of 4.5 in IELTS, studying in English at a variety of levels. See link for more ways: Functional English.
AMEP
We are also of the opinion that if applicants cannot meet the Functional English level then they may be able to meet the requirements by studying English classes with AMEP.
There could also be the possibility of paying a second visa application charge for those who cannot meet any of the above.
We are also under the opinion that the changes will only affect those applicants who are at the second stage of the their partner visa application. ie those applying for 2nd stage permanent processing. That is it would be a requirement to obtain the permanent visa. (ie 801 or 100 subclasses).
